Splošni pogoji poslovanja

S spletno trgovino https://www.art-myself-and-i.com/ upravlja podjetje Aleksandra Rogić, umetniško ustvarjanje, s.p. (Trg komandanta Staneta 8, 1000 Ljubljana, Davčna številka: 70150664, Matična številka: 9778608000).

Ti splošni pogoji določajo delovanje spletne trgovine ter urejajo pravice in obveznosti med ponudnikom (podjetje Aleksandra Rogić, umetniško ustvarjanje, s.p.) in kupcem.

V njih so opredeljeni postopki naročanja, plačevanja, dostave in možnosti vračila izdelkov. Kupec je zavezan k upoštevanju pogojev, ki veljajo ob oddaji naročila. Z oddajo naročila potrjuje, da je seznanjen z veljavnimi pogoji poslovanja. Za nakup izdelkov registracija ni potrebna.

Splošni pogoji so skladni z Zakonom o varstvu potrošnikov (Uradni list RS, št. 98/04 – uradno prečiščeno besedilo, 114/06 – ZUE, 126/07, 86/09, 78/11, 38/14, 19/15, 55/17 – ZKolT in 31/18). Pridržujemo si pravico do sprememb pogojev brez predhodnega obvestila.

2. Ponudba izdelkov

Ponudba izdelkov v spletni trgovini se zaradi narave poslovanja preko spleta pogosto in hitro spreminja ter ažurira.

3. Načini plačila

Ponudnik kupcu omogoča naslednje načine plačila nakupa izdelkov iz spletne trgovine:

Plačilo po predračunu, in sicer z nakazilom na TRR; podrobna navodila o plačilu bodo poslana na navedeno elektronsko pošto kupca.
Poleg spletne cene izdelka pri nakupu originalnih slik, slik po naročilu ter printov ni potrebno plačati stroškov embalaže in pakiranja.
Stroške pošiljanja v Slovenijo krije ponudnik, stroške pošiljanja izven Slovenije krije kupec.
Stroški pošiljanja izven Slovenije bodo navedeni v predračunu. Dodatne morebitne stroške carinskih dajatev pri pošiljanju v tujino krije kupec.
Vaše naročilo je sprejeto, ko dobimo potrdilo o transakciji iz naše banke.
Plačilo za izdelke po naročilu: o ceni in o načinu plačila se dogovorimo s stranko. Po potrditvi naročila vas bomo obvestili o vseh podrobnostih plačila. Za morebitna vprašanja ali informacije smo vam na voljo na rogic.aleksandra.art@gmail.com.

4. Cene

Vse cene v spletni trgovini so navedene v evrih, razen če je izrecno navedeno drugače. Vse cene v spletni trgovini so cene izdelkov in ne vsebujejo stroškov pakiranja in dostave. Vse cene veljajo samo za elektronsko naročilo izdelkov prek spletne trgovine.

Podjetje Aleksandra Rogić, umetniško ustvarjanje, s.p., ni davčni zavezanec v skladu z Zakonom o davku na dodano vrednost (ZDDV-1), zato cene v spletni trgovini ne vključujejo DDV.

Vse cene veljajo v trenutku oddaje naročila, zato veljajo le do njihove vsakokratne spremembe. Kljub prizadevanju, da bi ponudnik zagotovil najbolj ažurne in točne podatke, se lahko zgodi, da je podatek o ceni napačen. V tem primeru in v primeru, ko se cena izdelka spremeni med obdelavo naročila, to je od trenutka oddaje naročila do potrditve naročila, bo ponudnik:

kupcu to sporočil in ga obvestil o novih cenah, kupec ima v takšnem primeru možnost svoje naročilo spremeniti ali ga deloma ali v celoti preklicati ali pa potrditi naročilo po novih cenah, vse brez dodatnih stroškov; oziroma
Kupcu omogočil odstop od nakupa in mu hkrati ponudil rešitev, ki bo šla v obojestransko korist in zadovoljstvo.

5. Postopek nakupa

Naročilo

Po izbiri izdelka v spletni trgovini, se izdelek premakne v košarico.

5.1 Pregled naročila:

Na podlagi izbora izdelkov s strani kupca se izpiše košarica izbranih izdelkov.

5.2 Vpis naslova za dostavo:

Kupec izpolni polja, ki so namenjena obdelavi naročila.

Glede na vrsto izdelka in vrednost naročila se kupcu izpiše cena izdelka (tukaj ni upoštevana dodatna cena storitev pošiljanja v tujino).

5.3 Pregled celotnega naročila:

Izpiše se seznam naročila in splošni pogoji za plačilo.

5.4 Potrditev naročila:

Kupec na svoj e-mail naslov prejme potrdilo o potrditvi naročila. Prav tako na elektronski naslov prejme predračun (ki v primeru pošiljanja izdelka v tujino vključujejo tudi stroške pošiljanja izven Slovenije). Pošiljanje izdelka v Slovenijo je prevzame ponudnik.

6. Odprema blaga

Prevzem izdelka/izdelkov se izvrši s poštno dostavo ob predhodnem plačilu izdelka/izdelkov. Izdelke dostavljamo po vsem svetu, ne glede na vašo lokacijo. Sodelujemo z dostavnimi službami, kot so DPD, GLS in Pošta Slovenije.

Po predhodnem dogovoru je možen prevzem izdelka/izdelkov na sedežu ponudnika.

Pošiljanje po pošti:

Prosimo, dovolite, da pripravimo vaš izdelek za pošiljanje v 1–2 tednih. Po predaji izdelka dostavni službi, je dostava odvisna od trajanja dostave zadevne dostavne službe.

Mednarodna dostava:

Ko bo paket predan zadevni dostavni službi, prosimo, upoštevajte 10–20 delovnih dni za prevoz, odvisno od vaše lokacije. Upoštevajte, da lahko za nekatere države paketi, potrebujejo dodaten čas za obdelavo skozi carinsko postopke in lahko so obdavčeni z uvoznimi dajatvami.

O odpremi blaga boste obveščeni preko elektronske pošte.

7. Prevzem blaga

Kupec je dolžan prevzeti blago od izvajalca na naslovu, kot ga je sam izbral v postopku nakupa, pod pogoji, ki jih določa izvajalec dostave.

Kupec je dolžan ob prevzemu blaga le-tega pregledati z vso potrebno skrbnostjo, ter ponudniku nemudoma sporočiti vsako napako. Z dnem prevzema blaga preide blago v last kupca, ter s tem nevarnost za poškodbe, uničenje ter odtujitev preide na kupca.

8. Kupoprodajna pogodba

Ponudnik kupcu izda račun v pisni obliki, z razčlenjenimi stroški in pojasnilom o pravici do odstopa od nakupa z vrnitvijo kupljenega izdelka in pogoji vračila. Kupoprodajna pogodba med ponudnikom in kupcem se šteje za sklenjeno v trenutku, ko ponudnik kupcu potrdi naročilo. Od tega trenutka dalje so vse cene in drugi pogoji nakupa fiksirani in veljajo tako za ponudnika kot za kupca.

9. Pravica do odstopa potrošnika od nakupa, vračilo izdelkov

Vsak kupec je dolžan nemudoma, najkasneje pa v roku 5 dni po prejemu blaga, obvestiti ponudnika po e-pošti na kontaktni elektronski naslov rogic.aleksandra.art@gmail.com in pri izvajalcu dostave, če je poštni paket, s katerim je kupec prejel naročene izdelke, fizično poškodovan, če v njem manjka vsebina ali če kaže znake odprtja, sprožiti postopek reklamacije. Kupec lahko uveljavlja svoje pravice iz naslova morebitne stvarne napake na blagu, če pri tem izpolni pogoje, določene v veljavnem Zakonu o varstvu potrošnikov Republike Slovenije oziroma v Obligacijskem zakoniku Republike Slovenije.

Kupec, ki je potrošnik (fizična oseba), ima po predpisih o varstvu potrošnikov pravico, da v 14-ih dneh od dne prevzema naročenih izdelkov ponudniku na kontaktni elektronski naslov rogic.aleksandra.art@gmail.com sporoči, da odstopa od nakupa, pri čemer mu ni potrebno navesti razloga za takšno odločitev. Vrnitev kupljenih izdelkov ponudniku v roku za odstop od nakupa šteje za sporočilo o odstopu. Edini strošek, ki bremeni potrošnika v zvezi z odstopom od pogodbe, je strošek vračila artiklov. Kupljene izdelke je potrebno vrniti ponudniku najkasneje v roku 14 dni od dne oddanega sporočila o odstopu od nakupa. Kupljene izdelke je potrebno vrniti ponudniku nepoškodovane, v originalni embalaži in v nespremenjeni količini, razen če so izdelki uničeni, pokvarjeni, izgubljeni ali se je njihova količina zmanjšala, ne da bi bil za to kriv potrošnik in je potrošnik o tem ustrezno obvestil ponudnika. Potrošnik artiklov ne sme uporabljati do odstopa od nakupa. Potrošnik sme opraviti ogled artiklov v obsegu, kot je to nujno potrebno za ugotovitev dejanskega stanja. Potrošnik odgovarja za zmanjšanje vrednosti blaga, če je bilo blago prejeto nepoškodovano in v ustrezni količini. Za vrnjene izdelke ponudnik potrošniku najkasneje v roku 14 dni od prejema vrnjenega blaga vrne prejeto plačilo. Vračilo vplačanega zneska ponudnik izvrši z enakim plačilnim sredstvom, kot ga je uporabil potrošnik, razen če je potrošnik izrecno zahteval uporabo drugega plačilnega sredstva in če ponudnik zaradi tega ne nosi nobenih stroškov. Potrošnik nima pravice do odstopa od nakupa pri nakupih, katerih predmet je artikel, ki je bil izdelan po navodilih kupca, ki je bilo prilagojeno njegovim osebnim željam.

10. Darilni boni:

Veljavnost darilnih bonov:
Darilni boni so veljavni eno leto od datuma izdaje. Po preteku tega obdobja bon preneha veljati in ga ni mogoče več uporabiti.

Uporaba darilnih bonov:
Darilni boni se lahko uporabijo za nakup izdelkov na spletni strani www.art-myself-and-i.com. Za uporabo bona kontaktirajte trgovino ob naročilu izdelka, da bo ponudnik upošteval vrednost bona pri izračunu končne cene izdelka. Bon je mogoče uporabiti le enkrat, razen če je navedeno drugače. Darilni boni niso zamenljivi za gotovino.

Omejitve:
Darilni boni ne veljajo za plačilo poštnine ali drugih dodatnih stroškov.

Izguba darilnega bona:

Ponudnik ne prevzema odgovornosti za izgubo darilnih bonov po izdaji in se jih ne da nadomestiti.

11. Odgovornost

Ponudnik se po svojih najboljših močeh trudi zagotoviti ažurnost in pravilnost podatkov, ki so objavljeni v njegovi spletni trgovini, vendar se lahko lastnosti izdelkov, rok dobave ali cena spremenijo tako hitro, da ponudnik ne uspe pravočasno popraviti podatkov, ki so objavljeni v spletni trgovini. V takem primeru bo ponudnik kupca obvestil o spremembah in mu omogočil odstop od naročila ali spremembo naročila.

Ponudnik od trenutka odpreme blaga ne odgovarja za primere, ko pride do fizičnih poškodb, uničenja ali izgube pošiljke, kakor tudi ne, če pride do manjka vsebine v pošiljki ali če pošiljka kaže znake odprtja. V navedenih primerih mora kupec sprožiti postopek reklamacije pri izvajalcu dostave in o tem obvestiti ponudnika v skladu s temi Splošnimi pogoji in vsakokratnimi veljavnimi predpisi.

12. Pritožbe, spori in uporaba prava

Ponudnik spoštuje veljavne predpise s področja varstva potrošnikov. Ponudnik ima vzpostavljen učinkovit sistem obravnavanja pritožb in ima določeno osebo, s katero se v primeru težav kupec lahko poveže po elektronski pošti. Pritožbo lahko kupec odda na elektronski poštni naslov rogic.aleksandra.art@gmail.com. Postopek obravnave pritožbe je zaupen.

Ponudnik bo v 5 delovnih dneh po prejemu pritožbe potrdil, da je prejel pritožbo in sporočil kupcu, kako dolgo jo bo obravnaval ter ga vseskozi obveščal o poteku postopka. Ponudnik si bo prizadeval po svojih najboljših močeh morebitne spore rešiti sporazumno. Če sporazumna rešitev spora ne bo dosežena, je za reševanje vseh sporov med ponudnikom in kupcem izključno krajevno pristojno stvarno pristojno sodišče v Ljubljani.

13. Pravice do intelektualne lastnine

Aleksandra Rogić, umetniško ustvarjanje, s.p., je izključni nosilec pravic do produktov objavljenih na naši spletni strani.

Prepovedano je kakršno koli kopiranje izdelkov v komercialne ali druge namene.

14. Spremembe splošnih pogojev poslovanja

Ponudnik lahko v primeru sprememb predpisov, ki urejajo poslovanje spletnih trgovin, varstvo podatkov ter druga področja, ki so v zvezi s poslovanjem spletne trgovine ponudnika, in v primeru sprememb lastne poslovne politike spreminja in/ali dopolnjuje te Splošne pogoje poslovanja, o čemer bo vsakič seznanil kupce na primeren način, kamor šteje zlasti obveščanje prek spletne strani www.art-myself-and-i.com. Vsakokratne spremembe in/ali dopolnitve Splošnih pogojev poslovanja začnejo veljati in se uporabljati z iztekom osemdnevnega roka od objave sprememb in/ali dopolnitev. Če je sprememba in/ali dopolnitev Splošnih pogojev poslovanja nujna zaradi uskladitve s predpisi, lahko izjemoma te spremembe in/ali dopolnitve stopijo v veljavo in uporabo v krajšem času.

The online store https://www.art-myself-and-i.com/ is operated by Aleksandra Rogić, Artistic Creation, s.p. (Trg komandanta Staneta 8, 1000 Ljubljana, Tax ID: 70150664, Registration Number: 9778608000).
These General Terms and Conditions define the operation of the online store and regulate the rights and obligations between the provider (Aleksandra Rogić, Artistic Creation, s.p.) and the customer.

They specify the procedures for ordering, payment, delivery, and the possibility of returning products. The customer is bound by the terms and conditions valid at the time the order is placed. By placing an order, the customer confirms that they are aware of the applicable terms of business. Registration is not required for the purchase of products.
The General Terms and Conditions comply with the Consumer Protection Act (Official Gazette of the RS, No. 98/04 – official consolidated text, 114/06 – ZUE, 126/07, 86/09, 78/11, 38/14, 19/15, 55/17 – ZKolT and 31/18). We reserve the right to amend the terms without prior notice.

2. Product Offer
The product offer in the online store frequently and rapidly changes and is updated due to the nature of online business.

3. Payment Methods
The provider offers the customer the following payment methods for products purchased through the online store:

Payment by pro forma invoice, by transfer to the provider’s bank account (TRR). Detailed payment instructions will be sent to the customer’s specified email address.
In addition to the online product price, for the purchase of original paintings, commissioned artworks, and prints, packaging and handling costs are not charged.
Shipping costs within Slovenia are covered by the provider; shipping costs outside Slovenia are covered by the customer.
Shipping costs outside Slovenia will be indicated in the pro forma invoice. Any additional customs duties for international shipping are borne by the customer.
Your order is accepted once we receive confirmation of the transaction from our bank.
Payment for commissioned products: the price and method of payment will be agreed with the customer. After order confirmation, we will inform you of all payment details. For questions or additional information, please contact us at rogic.aleksandra.art@gmail.com.

4. Prices
All prices in the online store are stated in euros, unless explicitly stated otherwise. All prices are product prices and do not include packaging or delivery costs. All prices apply exclusively to electronic orders through the online store.
Aleksandra Rogić, Artistic Creation, s.p., is not a VAT payer under the Value Added Tax Act (ZDDV-1), therefore prices in the online store do not include VAT.
All prices are valid at the time the order is placed and apply only until they are changed. Despite efforts to ensure the most accurate and up-to-date information, it may happen that a price is incorrect. In such cases, and if the product price changes during order processing (i.e., from the time the order is placed until it is confirmed), the provider will:

inform the customer and notify them of the new price; the customer may then modify the order, cancel it in whole or in part, or confirm it at the new price, all without additional costs; or
enable the customer to withdraw from the purchase while offering a mutually beneficial solution.

5. Purchase Procedure
After selecting a product in the online store, it is moved to the shopping cart.

5.1 Order Review:
Based on the customer’s product selection, a list of chosen products is displayed in the shopping cart.

5.2 Entering the Delivery Address:
The customer fills in the fields required to process the order.
Depending on the product type and order value, the price of the product is displayed (excluding additional international shipping costs).

5.3 Order Overview:
The full order list and the General Terms and Conditions for payment are displayed.

5.4 Order Confirmation:
The customer receives an order confirmation via email, along with a pro forma invoice (which includes international shipping costs, if applicable). Shipping within Slovenia is covered by the provider.

6. Shipping of Goods
Products are shipped via postal delivery after payment is received. Products are shipped worldwide regardless of location. We work with delivery services such as DPD, GLS, and Pošta Slovenije.

By prior arrangement, products can also be collected at the provider’s address.

Postal Delivery:
Please allow 1–2 weeks for us to prepare your product for shipping. After the product has been handed over to the delivery service, the delivery time depends on the chosen courier.

International Delivery:
Once the package is handed over to the courier service, please allow 10–20 business days for delivery, depending on your location. Note that for some countries, packages may require additional processing through customs and may be subject to import duties.

You will be notified of shipping by email.

7. Acceptance of Goods
The customer must accept the goods at the delivery address they specified during the purchase process, under the terms defined by the delivery service.
Upon acceptance, the customer must inspect the goods with due diligence and immediately notify the provider of any defects. On the date of acceptance, the goods become the property of the customer, and the risk of damage, destruction, or loss transfers to the customer.

8. Sales Contract
The provider issues the customer a written invoice with itemized costs and an explanation of the right to withdraw from the purchase by returning the purchased product under the specified return conditions. The sales contract between the provider and the customer is deemed concluded when the provider confirms the order. From that moment, all prices and other purchase conditions are fixed and apply to both parties.

9. Right of Withdrawal and Product Returns
The customer must immediately, but no later than 5 days after receiving the goods, notify the provider by email at rogic.aleksandra.art@gmail.com if the postal package is physically damaged, missing contents, or shows signs of being opened, and must initiate a complaint procedure with the delivery service. The customer may exercise their rights regarding product defects if conditions specified in the applicable Consumer Protection Act of the Republic of Slovenia or the Obligations Code are met.

A customer has the right, under consumer protection regulations, to notify the provider within 14 days of receiving the ordered products, via email at rogic.aleksandra.art@gmail.com, that they are withdrawing from the purchase, without having to provide a reason. Returning the purchased products within this period is considered notice of withdrawal. The only cost to the consumer in connection with withdrawal is the cost of returning the products.
Products must be returned to the provider no later than 14 days from the date of the withdrawal notice. Products must be returned undamaged, in their original packaging, and in unchanged quantity, unless the products were destroyed, spoiled, lost, or their quantity decreased without the consumer’s fault and the consumer properly informed the provider. Consumers may not use the products until withdrawal. They may only inspect them to the extent necessary to determine their actual condition. Consumers are liable for any reduction in value if the products were received undamaged and in proper quantity.

For returned products, the provider shall refund the payment no later than 14 days after receiving the returned goods. Refunds will be made using the same payment method used by the consumer unless the consumer explicitly requests another method and the provider does not incur additional costs.
The consumer does not have the right of withdrawal in cases where the product was custom-made according to the customer’s instructions or personalized to their wishes.

10. Gift Vouchers

Validity: Gift vouchers are valid for one year from the date of issue. After this period, they expire and can no longer be used.
Usage: Gift vouchers can be used for product purchases on www.art-myself-and-i.com. To use a voucher, contact the store when placing an order so the provider can apply the voucher value when calculating the final product price. Vouchers can be used only once unless stated otherwise. They cannot be exchanged for cash.
Restrictions: Gift vouchers cannot be used to pay for shipping or other additional costs.
Loss of Vouchers: The provider assumes no responsibility for lost vouchers after issuance, and they cannot be replaced.

11. Liability
The provider makes every effort to ensure that the information published in the online store is up-to-date and accurate, but product features, delivery times, or prices may change so quickly that the provider cannot update the data in time. In such cases, the provider will inform the customer of the changes and enable them to withdraw from or modify the order.

From the moment the goods are dispatched, the provider is not responsible for cases of physical damage, destruction, or loss of the shipment, nor if its contents are missing or the shipment shows signs of being opened. In such cases, the customer must initiate a complaint procedure with the delivery service and inform the provider accordingly.

12. Complaints, Disputes, and Applicable Law
The provider complies with the applicable consumer protection legislation. An effective complaint-handling system is in place, and a contact person is designated to handle issues via email. Complaints can be submitted at rogic.aleksandra.art@gmail.com. The complaint procedure is confidential.

The provider will confirm receipt of the complaint within 5 business days, inform the customer of the estimated processing time, and keep the customer informed about the progress. The provider will make every effort to resolve disputes amicably. If no agreement is reached, the court of competent jurisdiction in Ljubljana shall have exclusive jurisdiction for all disputes between the provider and the customer.

13. Intellectual Property Rights
Aleksandra Rogić, Artistic Creation, s.p., is the exclusive holder of rights to the products published on our website.
Any copying of products for commercial or other purposes is strictly prohibited.

14. Amendments to the Terms and Conditions
The provider may amend and/or supplement these General Terms and Conditions in case of changes to legislation governing online business, data protection, or other areas related to the provider’s operations, or in case of changes to its business policy. Customers will be notified in an appropriate manner, primarily through publication on www.art-myself-and-i.com.
Amendments and/or supplements shall take effect eight days after publication unless necessary earlier to comply with legal requirements.
